Glomz DMCA Policy

Version 1.0.0 · Effective October 27, 2026 · PDF · Questions: glomz@cyborama.com

Cyborama LLC ("Cyborama," "we," "us") operates Glomz at glomz.com. We respect the intellectual property rights of others and expect every creator who submits to Glomz to do the same. This policy explains how copyright owners can report infringing material under the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (the "DMCA"), and how creators can respond. It applies to the Glomz website, web player, rating system, the aggregated Glomz YouTube channel, and the 24/7 Glomz YouTube Live stream. It is part of the Glomz Creator Agreement (Section 12.5).

Send copyright notices and counter-notifications to our designated agent:

Email is the fastest route. Only copyright notices and counter-notifications should go to this agent. For removal of your own Submission, privacy questions, or anything else, use the contacts in Section 9.

If you believe material on Glomz infringes a copyright you own or are authorized to enforce, send a written notice to our agent that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work you claim is infringed. If one notice covers several works, include a representative list.
  3. Identification of the material you claim is infringing, with enough detail for us to find it. The Glomz page URL, the act name and song title, or the YouTube video or Live stream URL and a timestamp all help.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

A notice that is missing these elements may not be effective under the DMCA. If a notice substantially complies, we may contact you to complete it.

3. What We Do After a Valid Notice

4. Counter-Notification

If your Submission was removed or disabled because of a notice and you believe that was a mistake or misidentification, you may send a counter-notification to our agent that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, any judicial district in which Cyborama may be found, and that you will accept service of process from the person who provided the original notice or that person's agent.

When we receive a valid counter-notification, we will promptly send a copy to the person who sent the original notice. We may restore the material in not less than 10 and not more than 14 business days after receiving the counter-notification, unless our agent first receives notice that the complaining party has filed an action seeking a court order to restrain the creator from the infringing activity on Glomz. Restoration under this section does not obligate us to republish or rotate the Submission; the Creator Agreement curation terms (Section 7.2) still apply.

5. Misrepresentation

Under 17 U.S.C. Section 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. If you are not sure whether material infringes your rights, consider consulting an attorney before sending a notice.

6. Repeat Infringers

Cyborama will, in appropriate circumstances, terminate the creator accounts of users who are repeat infringers. We may also remove material or suspend an account at our discretion when we believe a creator has infringed the rights of others, whether or not a formal DMCA notice was sent.

7. PRO and Licensing Complaints

Complaints from ASCAP, BMI, SESAC, GMR, or a similar organization about public performance licensing are handled under Creator Agreement Section 7.3. Those Submissions are removed the same day without waiting for the DMCA process. Rights organizations may still use the agent in Section 1 for formal notices.

8. Fees Paid for Removed Submissions

Submission Fees are governed by Creator Agreement Section 9.5. A Submission removed after publication because of a copyright notice is not refunded except where a refund is required by law.
