Glomz Privacy Policy
Cyborama LLC ("Glomz," "we," "us," or "our") operates the website, application, and music aggregation platform located at glomz.com (the "Service"). This Privacy Policy describes how we collect, use, and protect information when you register as a creator, submit audio/video content, and interact with our platform.
The Glomz Creator Agreement at glomz.com (and any linked copy) governs your Submissions. This Privacy Policy covers personal and technical data we process in connection with the Service.
1. Information We Collect
A. Creator Account and Profile Information
When you register an account, complete our rights checklist, or submit a video, we collect information you explicitly provide, including:
- Your legal name, stage/act name, and email address.
- Your band or company affiliation (if applicable).
- Your explicit responses to our upload rights and Performance Rights Organization (PRO) registration checklists.
- Password credentials, stored as a secure hash (we do not store plaintext passwords).
B. Mandatory Contractual Acceptance Records
To verify your binding assent to the Glomz Creator Agreement, our system automatically records a secure digital archive of the transaction, including:
- The exact date and time of your acceptance (UTC).
- The Internet Protocol (IP) address utilized.
- Your browser user agent string.
- The agreement version number and a cryptographic text hash of the specific agreement text you accepted.
- Your Glomz account ID.
C. Automated Content Analysis Data
When you upload an .mp4 Submission to the platform, we utilize technology to protect our channel aggregation ecosystem, which generates:
- Acoustic and visual content fingerprints via automated rights-screening tools.
- Content screening metadata to evaluate submissions before manual human review.
D. Usage, Ratings, and Technical Logs
When you or viewers use the Service, we may also collect:
- Play counts, stream timestamps, and related operational logs.
- User ratings, upvotes/downvotes, and text reviews of Submissions.
- Session cookies or equivalent login tokens needed to keep you signed in.
- Basic server and security logs (for example, request times and error events).
E. Payment Information
When you pay the one-time creator hosting/service fee (or any other fee we charge through the Service), payment card details are collected and processed by our payment processor, Stripe. We do not store full card numbers on Glomz servers. We may receive limited payment metadata from Stripe (for example, payment status, last four digits, billing country, and a Stripe customer or payment id) needed for receipts, refunds, fraud prevention, and accounting.
2. How We Use Your Information
We process and utilize your personal and technical data for the following operational tasks:
- Contract Enforcement: To retain legal evidence that you agreed to the platform's streaming rules and attested that your music is clear of PRO and publisher conflicts as required by the Creator Agreement.
- Channel Aggregation & Distribution: To display your provided act name, text credits, and video thumbnail alongside your streaming material on our web platform and YouTube broadcasts.
- Rights Verification and Takedown Response: To reference historical play logs, rating data, and timestamp records to defend the platform against third-party or PRO licensing claims.
- Moderation and Curation: To run automated pre-filters and support human approval before publication.
- Platform Security: To identify abuse or fraud, enforce account bans, and preserve channel health.
- Account Communications: To email you about approvals, removals, PRO complaints, security issues, and material updates to this Policy or the Creator Agreement.
- Payment Processing: To collect fees, issue discretionary refunds when we choose to, prevent fraud, and keep payment records with Stripe.
3. Data Sharing and Third-Party Providers
We do not sell, rent, or trade creator data. We share your information only as needed to operate the Service:
- Technical Infrastructure Providers: Hosting, content delivery networks (CDNs), media transcoders, databases, and email delivery required to serve and stream your .mp4 file and run accounts.
- Payment Processor (Stripe): Card and payment data for fees and refunds. Stripe processes payments under its own privacy policy; Glomz receives only the limited metadata described in Section 1.E.
- Rights Screening Partners: Automated audio/video fingerprinting services used to detect copyright anomalies or PRO-related signals before our human curation step.
- Public Platform Surfaces: Your public stage name, thumbnail, and media Submissions are displayed to platform users for ratings and may be broadcast to the general public via the Glomz YouTube channel and 24/7 YouTube Live stream. Viewing on YouTube is also subject to Google/YouTube's own terms and privacy policy.
- Legal and Safety: We may disclose information if required by law, legal process, or to protect Cyborama, creators, users, or the public from harm or rights violations.
- Business Transfer: If Cyborama is involved in a merger, acquisition, or asset sale, information may transfer as part of that transaction, subject to this Policy's protections.
4. Data Retention and Account Deletion
A. Active Content Purges
If you utilize our account tools or email our rights contact to revoke your streaming license, we will make commercially reasonable efforts to delete your master .mp4 media files from active production servers and pull them from active rotations and bumper cycles within our operational target window of about 72 hours, as described in the Creator Agreement.
B. Records That May Remain
Pursuant to Section 10.3 of the Glomz Creator Agreement, certain records are not fully erased by a removal request:
- Historical play logs, user rating statistics, and written text reviews.
- The baseline Acceptance Record (including IP address, timestamp, agreement version, text hash, account ID, and checklist answers), retained while needed to evidence assent and defend disputes.
- Past YouTube live-stream archives hosted by YouTube that we cannot retroactively edit.
- Temporary system backups, which will be destroyed within six months of the initial transmission unless preserved exclusively for archival purposes.
C. Account Closure
You may request account closure through the contact below. We will delete or de-identify account profile data that is no longer needed to operate the Service or meet legal and contractual obligations, subject to Section 4.B.
5. Age Requirement
The Service is for users who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it.
6. Security
We use reasonable technical and organizational measures to protect information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your Choices and Requests
Subject to applicable law and the Creator Agreement, you may request access to, correction of, or deletion of personal information we hold about you by contacting us as described below. We may need to verify your identity and may retain information as allowed or required for legal, security, or contractual purposes (including Acceptance Records and play logs described in Section 4.B).
If a U.S. state privacy law applies to you, we will honor applicable rights (such as access or deletion) upon a verified request.
8. Updates to This Policy
We may periodically update this Privacy Policy to reflect changing regulatory requirements or platform features. We will denote updates by changing the Effective Date and Version at the top of this document. Continued use of the platform after a posted update constitutes acknowledgement of the revised Policy for future use of the Service.
